Start with the contract administration record.
NEC guidance describes compensation events through clauses 60–65, covering the events themselves, notification, quotations, assessment and incorporation into the contract. For delay assessment, NEC guidance emphasises the Accepted Programme and the effect of the particular compensation event.
In practice, a useful dispute file normally includes the Contract Data, Scope, relevant Z clauses, Accepted Programmes, early warnings, compensation event notices, quotations, Project Manager communications and payment records.
Why do Z clauses matter?
Z clauses can change the standard form. A dispute cannot safely be analysed from an unamended NEC summary if the executed contract reallocates risk or changes procedures.
What is the first task in an NEC delay dispute?
Preserve the programme history and establish which programme was accepted at the relevant time, alongside the event notices and contemporaneous communications.
