For a straightforward monetary claim up to £100,000 excluding VAT and interest, the TeCSA Low Value Disputes service can cap the adjudicator’s fees, provided the contractual nomination arrangements allow it.
TeCSA Low Value Disputes service
TeCSA’s current service is available for claims for a specified sum of money up to £100,000, excluding VAT and interest. It caps the adjudicator’s fees on a sliding scale. TeCSA states that the other party’s agreement is not required where the contractual nomination arrangements permit the TeCSA LVD route.
Other low-value procedures
Other adjudicator nominating bodies also operate capped or streamlined schemes. Check which body the contract names, because that can determine the available procedure.
Keeping your own costs down
A cap on the adjudicator’s fee does not cap your own legal costs. A defined scope and a fixed or capped solicitor fee can therefore matter just as much. HQ Law publishes fixed fees for payment notice reviews, notice-failure payment adjudications and value-banded adjudication representation.
Chris Hough is a TeCSA Accredited Panel Adjudicator. HQ Law does not act for a party in any adjudication in which Chris is appointed.
